ORDINANCE NO. 14,853

 

AN ORDINANCE to amend the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, by adding and enacting a new Section 78-11 regarding the allowed procedures for enforcement of the regulations applicable to peddlers, transient merchants, and solicitors.

 

BE IT ORDAINED by the City Council of the City of Des Moines, Iowa:

 

Section 1.  That the Municipal Code of the City of Des Moines, Iowa, 2000, adopted by Ordinance No. 13,827, passed June 5, 2000, be and is hereby amended by adding and enacting a new Section 78-11 regarding the allowed procedures for enforcement of the regulations applicable to peddlers, transient merchants, and solicitors, as follows:


 

Sec. 78-11.  Civil violations and penalties.

(a)        No person shall engage in or cause any activity to be done in violation of any provision of this chapter.

(b)        Persons who fail to perform an act required by the provisions of this chapter or who commit an act prohibited by the provisions of this chapter shall be guilty of a misdemeanor punishable by fine or imprisonment as provided by section 1-15 of the City Code, or shall be guilty of a municipal infraction punishable by a civil penalty as provided by section 1-15 of the City Code.

(c)        The city may obtain injunctive relief to enforce the provisions of this chapter.


 

Sec. 2.  This ordinance shall be in full force and effect from and after its passage and publication as provided by law.
