ORDINANCE NO. 14,865
AN ORDINANCE renaming streets recently annexed into the City of Des Moines to fit within the City of Des Moines street naming and building numbering conventions and to eliminate duplicate street names.
WHEREAS,
on June 22, 1998, by Roll Call No. 98-2075, the City Council approved the
involuntary annexation of areas in Polk and Warren Counties located northeast,
southeast and south of the City boundaries, and islands of unincorporated land
within the City boundaries; and,
WHEREAS,
the involuntary annexation was filed with the City Development Board in Docket
No. UA98-03, and on September 1, 2005, the involuntary annexation was approved
by the local committee formed to consider the matter; and,
WHEREAS,
on November 8, 2005 the involuntary annexation was approved at the required election; and,
WHEREAS,
on March 26, 2009, the Iowa Court of Appeals upheld the decision of the Polk
County District Court affirming the decision of the local committee to approve
the involuntary annexation; and,
WHEREAS,
on June 26, 2009, the involuntary annexation became effective upon recording of
the annexation proceedings in Polk and Warren counties; and,
WHEREAS,
substantial portions of the areas originally included within the involuntary
annexation were brought into the City of Des Moines by voluntary
annexations; and,
WHEREAS,
the areas voluntarily annexed into the City of Des Moines and the remaining
areas brought into the City of Des Moines by the completion of the involuntary
annexation include streets (formerly county roads) or segments of streets with
names that do not fit within the City of Des Moines street naming and building
numbering conventions or that duplicate existing street names; and,
WHEREAS,
it is essential for the efficient and expeditious delivery of emergency
services that every property have a unique address and that the street names
and building numbers for all properties fit within the City of Des Moines
street naming and building numbering conventions and not duplicate street names
and building numbers in the adjoining jurisdictions; NOW THEREFORE,
BE
IT ORDAINED by the City Council of the City of Des Moines, Iowa:
Section 1. That the portions of the streets set forth in the following table and located within the City of Des Moines, Iowa, on the effective date of this ordinance shall be and are hereby given the new name set forth in the following table, and shall hereafter be know by such new name:

Sec. 5. This ordinance shall be in full force and effect from and after its passage and publication as provided by law.

The City Clerk is hereby further authorized and directed to forward a certified copy of this ordinance to the Polk County Auditor, the Polk County Assessor, the Warren County Auditor and the Warren County Assessor.
